We contacted Northern Planners to advise on the form of a residential development where access to the site was to be across land which we own and into which a triangle of development site land projected. We had never owned the development site and were the triangular projection to be built on as part of the residential development this would have generated rights of way and access and parking problems for the legitimate users of our land.
As a result of the input from Northern Planners, it was identified that the projecting triangle of land was not legally fully accessible as part of the residential development. This allowed us to come to a very satisfactory agreement with the residential developers whereby, by exchanging small pieces of land, both they and we were able to preserve and enhance our holdings. At the same time, this exchange clarified and enhanced the parking aspects of both our land and that of the residential development land.
